Oldwage: We know that the evidence is that he was running down the passage towards the corridor.
Judge: Are you saying it is misleading to ask the witness where he got "run" from the record?
Oldwage: It had picked it up in the record.
Oldwage: There is two very distinct issues here.
Judge: I am trying to digest what you are saying.
Oldwage: I am saying the confusion as to when the running took place.
Oldwage: My submission is if that clarity had been done then, then there would have not been this confusion.
Judge: So you are saying there is running down the corridor?
Oldwage: Mr. Nel had put it that there was running from the bathroom back. The distinction should have been made clear.
Judge: Mr. Nel wanted to know where he got "run" from.
Oldwage: The witness could not recall, my lady.
Judge: Anything else. Maybe I need to read the record myself before I can come back to counsel.
Nel: My lady, that is not required. I would like to continue with the evidence.
Judge: We are going to carry on.
Oldwage: If the distinction had been drawn as to when the running had been made.
Nel: Let us just deal with some of the issues that we dealt with on Thursday. Your report is not a forensic report?
Nel: It is not a report dealing criminal capacity?
Nel: Whilst we are dealing with the record and I have said I am wrong. I want to refer you to the record.
Nel: You said when dealing with Divaris, when the accused got up in a fright. Have you read the record this week-end?
WD: Yes, it was referred to me by counsel.
WD: From Wednesday and Thursday, aswell as the record from previously.
Nel: Is it still in your evidence that you read it in the bail application?
Nel: You were given the bail application to read?
WD: I was given a document to read.
Nel: No, in your mind you were given the bail application?
WD: I was given a document to read from counsel.
Nel: I will put it to you that it is not in the bail application or the documents that were attached.
WD: I have it with me, my lady.
Nel: Now, the, you remember when we dealt on Thursday that you being the treating physician and giving evidence.
Nel: We know that your brief was very subjective. Or do you not agree with me?
