OP: My lady, I am not sure. I have been awake when somebody got up and I didn't say anything.
Nel: The concern is that you cannot sleep, and yet she didn't ask you anything further?
OP: No, my lady, she didn't.
Nel: When, I just want to take you to the first time you heard a noise in the bathroom. You picked up the jeans to cover the light, heard a noise and then what?
OP: You put two questions to me, my lady.
Nel: First noise that you heard in the bedroom?
Nel: You were clear that is was the bathroom window?
Nel: It was clear the noise?
OP: The noise was loud. It was the sliding and hitting the window frame.
Nel: If we are clear, if Reeva was in bed, then she would have heard the noise?
Nel: So would she have not given a response to you?
OP: No, she would have been scared and I had told her to phone the police.
Nel: That doesn't make sense. Having heard a window open, you would have asked her if she heard it.
OP: No, my lady, I wouldn't have.
Nel: You see you did not identify the noise in your statement.
Nel: In fact you heard two noises, why would you not have put that in your bail statement. It is so important.
OP: My lady, you keep going back to the bail application. I said that I heard 2 noises.
Nel: I stand corrected. You see, you will argue this. You are such a stickler for detail that you just corrected me.
Nel: So why would you not have said it was a noise from the window?
OP: My lady, my legal team did it and read it to me and it was right. It did not have to be an exhausted statement.
Nel: Why did you not put it in your statement?
OP: My lady, I heard a noise and then when I saw the window open, I knew it was from the window.
Nel: You see you are tailoring, a version that you adapted.
OP: That is not true, my lady.
Nel: There is another aspect. When you made the bail application, you were traumatised, not under medication. You understood the plea application?
OP: That is correct, my lady.
Nel: There is nothing about the window slamming against another window?
OP: It never slammed against the window, it slammed against the frame.
Nel: I out it on record, you corrected me again on the small detail.
OP: It is not a small detail.
Nel: Why is the big issue that it is not in your bail application?
Nel: Did they deliberately leave it out?
Nel :Why is it not dealt with?
OP: My lady, I am not sure.
Nel: Page 7, paragraph 4 point 7 of the bail application.
Nel: You deal with burglar bars but you not deal with slamming?
