Roux: I was paging through this file. What is in the investigation diary there?
Vermeulen: I just said that I received the evidence.
Roux: You spoke about the micro-scope to deal with the evidence?
Vermeulen: Yes, my lady. That is not in this file.
Roux: It has a camera in it, the micro-scope?
Vermeulen: No, my lady. I used one without a camera in it.
Roux: Let's deal with the file on the prosthetic leg. Where is that file?
Vermeulen: My lady, it was agreed that we would not need it.
Roux: Just to, assist the court because we have prepared all this and seen all the photos. The questions that I am going to put to you, we ask that photo 110 be screened.
Roux: Can you identify what you see on the photo?
Vermeulen: My lady, it was the door as it was found at the scene.
Roux: That is the door with out it's inside panels.
Roux: There we get some idea about the panels.
Vermeulen: That's correct, my lady.
Roux: Go to 113, can you identify the panel in the toilet.
Roux: Can you assist the course, in relation to the door.
Vermeulen: It is upside down, with the face down. The face of the outside of the door.
Roux: One possibilty is that he kicked the door and break in. He then could not break it and went to get the cricket bat. Would that not follow?
Vermeulen: No, my lady, It does not mean that he kicked out that panel. That's my version of the story.
Vermeulen: Sorry, my lady my theory. I never said it was a kick, I said the mark was caused by him stumbling over the door. I never said the kick.
Roux: We are working on the assumption that he kicked the door.
Vermeulen: I never said he kicked the door.
Roux: I am just testing how far you are able to consider the version of the accused. Can we do that?
Vermeulen: As long as I am not held to that.
Roux: So, the accused kicked it and could not get it open and then got the cricket bat.
Roux: Then we can assume that he had his prosthetic legs on.
Vermeulen: It he can kick that high, that's his version. If we consider that, that it's his version.
Roux: On that propersition?
Roux: I am just testing the version on an expert. On that version, it would make sense?
Vermeulen: Yes, my lady. He would be in an unnatural position.
Roux: Second thing that you raised, was of cause the mark could have been imprinted by him stumbling on it and that caused the mark?
Roux: Let's look at 120. Where would the foot print be on this picture?
Vermeulen: Facing the floor. Another important thing, if you look at this picture, the blood was smeared on the floor. The plank was put there after the blodd wa
Vermeulen: After the blood was smeared on the floor. It could have been moved into that position after the deceased was moved out of the bathroom.
Roux: There is another possibility, that he turned the plank over and stepped on it and then turned it back over.
Vermeulen: My lady, he could have moved it after moving the deceased or trying to move it away. He could have stepped on it or tripped over it.
Roux: He must step hard enough to mark that mark and then he must pick up the plank and turn it upside down.
Vermeulen: That is a possibility my lady.
